When utilities use our platform, we collect information including: organization name and Employer Identification Number (EIN), business address, phone number, and email address, utility account information, administrative user credentials and contact information, billing and payment information, system configuration and preferences, and usage data regarding platform interactions.
B. End User Information (Utility Customers)
At the direction of our utility clients, we process the following information about their customers: customer name and service address, contact information (phone numbers, email addresses), utility account numbers, smart meter data and consumption information, and communication preferences and opt-out requests.
C. Automatically Collected Information
When you access our Services, we automatically collect: log data (IP addresses, browser type, operating system, access times), device information, cookies and similar tracking technologies, and usage patterns and analytics data.
D. Communications Data
We maintain records of communications sent through our platform, including SMS messages, email notifications, emergency broadcasts, and delivery status information.
2. How We Use Your Information
We use the information we collect for the following purposes: to provide, maintain, and improve our Services; to process communications on behalf of utilities; to detect potential leaks and consumption anomalies; to manage regulatory compliance programs; to send emergency and service notifications; to manage utility programs; to analyze usage patterns and optimize platform performance; to provide customer support and respond to inquiries; to process billing and payments; to verify utility credentials and maintain account security; to comply with legal obligations and enforce our terms; and to protect against fraudulent, unauthorized, or illegal activity.

With Utilities: We share end-user data with our utility clients as necessary to provide our Services and at their direction.
For Legal Compliance: We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose Personal Information and any other information about you to government or law enforcement officials or private parties if, in our discretion, we believe it is necessary or appropriate to respond to legal requests (including court orders, investigative demands and subpoenas), to protect the safety, property, or rights of ourselves, consumers, or any other third party, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with law.
Business Transfers: In the event of a merger, acquisition, or sale of assets, user information may be transferred as part of that transaction. We will notify you via email or prominent notice on our website before your information becomes subject to a different privacy policy.
4. SMS and Email Communications (TCPA Compliance)
Our platform facilitates SMS and email communications between utilities and their customers. We comply with the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
Consent: All customer contact information used by Spout Services must be provided directly by the utility and must not be obtained through any other means. Messaging from the utility must remain closely related to the utility's services.
Opt-Out Rights: Recipients of messages can opt out at any time by replying "STOP" to SMS messages or clicking unsubscribe links in emails. We process opt-out requests immediately and maintain do-not-contact lists.
Emergency Communications: Critical safety and emergency notifications may be sent regardless of opt-out status when required by law or necessary to protect public health and safety.
5. Data Security
We implement appropriate technical and organizational measures to protect your information, including: encryption of data in transit and at rest, secure authentication and access controls, regular security assessments and monitoring, employee training on data protection, and incident response procedures.
